Od wczoraj na Placu S. Daukantasa przed prezydenturą trwa strajk głodowy grupy osób z Kowna, protestujących przeciwko samowoli sędziów, którzy, zdaniem uczestników akcji , nie bronią ogólnoludzkich wartości, prawa, prawdy i sprawiedliwości.

W apelu, skierowanym na ręce prezydent D. Grybauskaitė głodujący zaznaczają, iż samowola sędziów osiągnęła niebezpieczną dla państwa skalę.

Jūsų Ekscelencija Lietuvos Respublikos Prezidente!

Kreipiamės į Jus kaip valstybės vadovę (LR Konstitucijos 77 str.), kurios priedermė rūpintis visų valstybės funkcinių subjektų veikla.

Pagal savo funkcinę paskirtį teismai turi spręsti ginčus dėl teisėtumo ir teisingumo. Tačiau dalis Lietuvos teismų teisėjų savo vaidmenį valstybėje supranta kitaip. Jie nesiekia ginti žmogiškųjų vertybių ir atkurti teisinės taikos, kaip to reikalauja LR CPK 2 straipsnis, o vykdo teisminį procesą vardan proceso. Tai vyksta ne tik dėl sąmoningo nedorų teisėjų piktnaudžiavimo tarnyba, turint savanaudiškų interesų, bet ir dėl kai kurių teisėjų nesupratimo, jog teisingumas yra dorovinė vertybė, o ne teisminė procedūra. Vykdyti teisingumą – tai atlikti pareigą tiesai, o ne vadovauti teismo procesui. Tenka konstatuoti, jog teismai Lietuvoje virsta nekontroliuojama uždara (klanine) sistema.

Atkreiptinas dėmesys, kad Jungtinėse Tautose patvirtinti Pagrindiniai teismų nepriklausomumo principai Lietuvoje suprantami kitaip, nei jų lingvistinė ir loginė prasmė. Jeigu tarptautinis aktas teisėjo nepriklausomumą aiškina kaip teisėjo pareigą nepasiduoti spaudimui, išorinėms paskatoms, tiesioginiam ir netiesioginiam įsikišimui ar grasinimui, tai Lietuvoje teisėjo nepriklausomumas suprantamas kaip nekontroliuojama galimybė savavaldžiauti.

Jeigu tarptautinis aktas kiekvieną teisėją (nepriklausomai nuo jo rango) įpareigoja „vadovautis faktais ir įstatymais“, tai Lietuvoje kasacinės instancijos teismo teisėjas yra saistomas ne faktų ir bylos medžiagoje pateiktų aplinkybių, o „pirmosios ir apeliacinės instancijos teismų nustatytų aplinkybių“ (LR CPK 353 str. 1d.). Tai reiškia, kad žemesniojo teismo absurdiškos klaidos atveju, kasacija įstatymą taiko absurdui. Ar nežeidžia teisėjo orumo, kai jis verčiamas paklusti absurdui?

Jeigu tarptautinis aktas įpareigoja teisėją vadovautis įstatymais, t.y. užtikrinti įstatymo viršenybę, tai Lietuvos nacionalinė teisė (Teismų įstatymo 23 ir 31 straipsniai) teisėjams leidžia savaip aiškinti įstatymą, įstatymo viršenybę pakeičiant teismo išaiškinimo viršenybe. Ar įstatymo leidėjo valią pakeitus teisėjo valia atsiranda daugiau teisingumo?

Įstatymo viršenybę pakeitus teismine savivale, nesant už pareiginius pažeidimus teisėjo atsakomybės (LR CK 6.272 str. 2d.), kasacinę teismo instanciją susaisčius draudimu teisėjui vertinti bylos aplinkybes (LR CPK 353 str. 1d.) ir tuo draudimu teisėjui netenkant nepriklausomumo, (kaip pavyzdį žiūrėti LAT 2015-10-30 nutartį civ. byloje Nr. 3K-3-571-916/2015), be to teismuose praktiškai atsisakius viešo bylų nagrinėjimo (LR CPK 321, 322, 356 str.), pažeidžiant LR Konstitucijos 117 str., ir teisėjams leidžiant pasirinkti, kurio žmogaus teises ginti, o kurio ne (LR CPK 350 str.), taip pažeidžiant asmenų lygiateisiškumo principą (LR Konstitucijos 29 str.), Lietuvos teismus laikyti europinio lygmens valstybės funkcinių subjektų sistema nėra jokio pagrindo.

Faktai liudija, kad teisėjų savivalės tendencijos šalies gyvenime pasiekė Tautai pavojingą mastą. Dėl jų piliečių nepasitikėjimas valstybe vis gilėja, o visuotinis žmonių beviltiškumas ir nulemia masinę emigraciją. Deja, valstybiniame sektoriuje į tai žvelgiama abejingai.

Vertinant viso to padarinius, valstybės institucijų abejingumą demografiniam Tautos nukraujavimui galima prilyginti latentiniam Tautos genocidui.

Your Excellency Ms President of the Republic of Lithuania!

We are addressing you as the head of State (Article 77 of the Lithuanian Constitution) who has an obligation to supervise the operations of all functional bodies of the country.

According to their functional purpose, courts must solve disputes regarding legitimacy and justice. However, some of the judges of Lithuanian courts have a different understanding of their role within the state. Instead of striving to protect human values and restore juridical peace as required by Article 2 of the Code of Civil Procedure of the Republic of Lithuania (hereinafter “LR CPK”), they carry out a judicial process for the sake of a process itself. The reason behind this is both the wilful abuse of office by immoral judges with selfish interests in mind and also the failure of some judges to understand that justice is a moral value rather than a judicial procedure. Administering justice means performing one’s obligations to the truth rather than just chairing a judicial process. We regret to conclude that Lithuanian courts are turning into an uncontrollable closed (clan-based) system.

We want to note that, in Lithuania, the Basic Principles of the Independence of the Judiciary approved by the United Nations are understood differently from what their linguistic and logical meaning suggests. The international act interprets an independence of a judge as an obligation to withstand pressure, external inducement, and direct or indirect interference or threats, whereas in Lithuania, an independence of a judge is understood as an opportunity for uncontrolled arbitrariness.

The international act obliges each judge (regardless of his/her rank) to make decisions “on the basis of facts and in accordance with the law”. However, in Lithuania, the judges of cassation courts are bound not by facts and circumstances stated in the case materials but by “the circumstances established by the courts of first instance and appeal courts” (Article 353(1) of LR CPK). This means that, in case of an absurd error by a lower instance court, the cassation court has to apply the law to the absurdity. Being forced to obey the absurdity is an offence against the dignity of a judge, is it not?

The international act obliges judges to follow the law, i.e. to ensure the rule of law, whereas the Lithuanian national law (Articles 23 and 31 of the Law on Courts) allows judges to interpret the law in their own way by replacing the rule of law with the rule of court`s interpretation. Does replacing the will of a legislator with the will of a judge ensure any more justice?

Considering that the rule of law has been replaced with judicial arbitrariness, the judges are not held responsible for official misconducts (Article 6.272(2) of the Civil Code of the Republic of Lithuania), a capacity of the cassation court has been restricted by the prohibition from considering the circumstances of the case (Article 353(1) of LR CPK) and, through this prohibition, the judges are deprived of an independence (see the ruling of the Lithuanian Supreme Court adopted on 30/Oct/2015 in a case No 3K-3-571-916/2015 as an example), moreover, that the practice of the public hearing of cases in courts has been practically eliminated (Articles 321, 322, and 356 of LR CPK) thus violating Article 117 of the Lithuanian Constitution and the judges are allowed to choose whose rights to protect (Article 350 of LR CPK) thus violating the principle of equal rights (Article 29 of the Lithuanian Constitution), there is no reason to consider Lithuanian courts to be a European-level system of functional bodies of the state.

The facts show that the growing trends of arbitrariness among judges of the country have reached critical levels for the Nation. As a result, the citizens increasingly distrust the State as such and the universal despair of people is the main reason behind a massive emigration. Unfortunately, the public sector regards this with indifference.

Considering the consequences of all this, such indifference of the state authorities towards the demographic deterioration of the Nation could be compared to a latent genocide of the Nation.
